IRS Tax Relief With the Cohan Rule

Taxpayers facing IRS debt problems due to unfiled tax returns are not alone; a typical Tax Resolution Services non-filing client has between 4-7 years of unfiled tax returns.? The good news is that even if they have no documents, we can still file the missing tax returns and begin the process of getting these taxpayers into tax compliance. This is possible due in large part to vaudevillian entertainer, George M. Cohan, who won a groundbreaking tax audit case over 80 years ago that set precedence for cases today. An Accounting Web article titled Give your Regards to the Cohan Rule explains how Conan?s case began the ?Cohan rule? allowing tax professionals to use statistical data to determine taxable income for taxpayers with little to no proof of documentation.

George M. Cohan, as described by Wikipedia, was an American entertainer, playwright, composer, lyricist, actor, singer, dancer and producer known for song standards such as ?Give My Regards to Broadway?, ?The Yankee Doodle Boy? and ?You?re a Grand Old Flag?. There is even a statue in his honor in Times Square. But while we can thank Cohan for his musical contributions, the Accounting Web article suggests his most enduring legacy could be his 1930?s US Tax Court case (Cohan v. Comm?r, 39 F.2d 540 (2d Cir. 1930).

In the landmark decision, Cohan was permitted to deduct certain business expenses, even though he didn?t have all the receipts needed to back up his claims with certainty. According to the article, under the Cohan rule, the court can approve deductions if it?s convinced that expenses were actually incurred, even if the records don?t measure up.

In tax resolution cases since we need to file their back tax returns, we can employ the Cohan Rule to help taxpayers that do not have their records for whatever reason. The rule allows us to use national standards released by the IRS and other tax agencies each year. The Almanac of Business and Industrial Financial Ratios, or as I call it ?the bible?, allows us to access an SIC code filing for the taxpayer who has no previous financial information. We then determine on average what the IRS will accept all these deductions and the income in spite of the fact that they cannot produce any documents.

The IRS understands that a business person making money also has expenses, such the case for George M. Cohan. It?s clear his showman?s legacy will continue to live on and be praised. Hopefully, Cohan will equally be remembered for winning his IRS tax audit case over eighty years ago that continues to make it possible for tax experts like me to help delinquent taxpayers and small business audit victims who need it the most.

UK student convicted of denial of service attack

LONDON (AP) -- A London jury convicted a 22-year-old student and member of the hacking group Anonymous on Thursday of taking part in cyberattacks on several major companies' computer systems.

Self-described "hacktivist" Christopher Weatherhead showed no emotion after being convicted of conspiracy to impair the operation of computers. The attacks hit the sites of MasterCard, Visa, PayPal and several others. He will be sentenced at a later date.

Three co-conspirators of Weatherhead pleaded guilty to the same charge in January and March.

Prosecutor Russell Tyner said Weatherhead and the others targeted companies in the music industry involved in combating Internet piracy and firms that had stopped processing online donations to the data-leaking site WikiLeaks. Tyner said the attacks cost these companies more than 3.5 million pounds ($5.6 million).

Working under online nicknames including "Nerdo" and "NikonElite," the group hit their targets with denial-of-service attacks ? a technique that works by overloading a website with traffic.

They also used Facebook and Twitter to recruit followers and publicize their attacks, according to police.

The cybercrime spree focused attention on Anonymous, a loose-knit collection of Web-savvy activists and Internet pranksters ? many of whom have targeted governments, officials or corporations over a variety of political grievances.

Nobel laureates urge China to release jailed prize winner Liu

BEIJING (Reuters) - A group of 134 Nobel laureates including the Dalai Lama and author Toni Morrison have written to Chinese Communist Party chief and president-in-waiting Xi Jinping urging that he release detained Peace Prize winner Liu Xiaobo and his wife.

Liu, a veteran dissident involved in 1989 pro-democracy protests crushed by the Chinese army, won the prize in 2010. He was jailed the year earlier and is serving an 11-year sentence. His wife Liu Xia is under house arrest.

"As you have taken the first step towards assuming the presidency of the People's Republic of China, we write to welcome the prospect of fresh leadership and new ideas," the laureates wrote, in a letter released on Tuesday.

"To that end, we respectfully urge you to release Dr. Liu Xiaobo, the world's only imprisoned Nobel Peace Prize Laureate, and his wife, Liu Xia."

The letter was also signed by the likes of South African peace campaigner Desmond Tutu and John Gurdon, joint winner of this year's medicine prize.

The laureates said restricting freedom of thought would have an impact upon creativity in all fields.

"Across all disciplines, the distinguishing feature which led to our recognition as Nobel Laureates is that we have embraced the power of our intellectual freedom and creative inspiration to do our part to advance the human condition."

"No government can restrict freedom of thought and association without having a negative effect on such important human innovation," they wrote.

The laureates noted that President Hu Jintao, during a visit to the United States last year, recognized that much needed to be done in China on human rights.

"While we welcome such honest assessments, we hope that China's new political leadership will move past merely recognizing the problem and seize this important opportunity to take concrete steps towards embracing the fundamental rights of all Chinese citizens."

China says that Liu is a criminal and should be treated as such, decrying criticism of the case as unwarranted interference in its internal affairs.

Xi takes over the presidency from Hu at an annual meeting of parliament in March.

The Communist Party, which values stability above all else, brooks no dissent to its rule and has shown no sign of relaxing its grip on power.

State lacks strategy on alternative energy, report says

California's push to add wind and solar energy to its existing power grid could saddle ratepayers with soaring electrical bills and despoil the state's environmental resources unless officials act soon, according to a report released Monday by a government watchdog agency.

Although it applauded the state's effort to reduce reliance on fossil fuels, the nonpartisan Little Hoover Commission said that a "balkanized" and "dysfunctional" collection of state energy agencies threatened to create a "profoundly expensive policy failure."

"The state has failed to develop a comprehensive energy strategy with clearly delineated priorities to ensure that policies are not working at cross-purposes," the report said. "Policies and regulations affecting electricity have been piled upon each other piecemeal, through multiple, sometimes overlapping public processes."

The 107-page analysis, "Rewiring California," outlined the mistakes made during the administration of former Gov. Gray Davis, which resulted in a crisis that sent electricity rates skyrocketing, and warned of the possibility of similar policy errors.

Among other recommendations, the commission urged the governor to establish a single overarching entity or agency to coordinate the state's energy policy.

State officials are not required to act on the group's advice. However, a spokesman said Gov. Jerry Brown would review the report.

The problems described in the report can be traced to California's ambitious legal requirement that the state utilities derive a third of their power from wind, solar and other renewable sources by 2020.

In the rush to incorporate new energy sources, the state has approved 20-year power agreements that lock in "unnecessarily high prices," the report says.

"This sets the stage for a potential ratepayer revolt," the report said.

Commission Chairman David Hancock said the complexity of the issue requires careful policy choices. "Getting it right is far more important than speed," he said.

The commission urged Brown to assess the real cost of the state's energy policies and determine whether they will help achieve the goal of reducing fossil fuel emissions. It also recommended a moratorium on further renewable energy policies.

The commission took note of the environmental effect of the energy initiative. California's deserts are scheduled to host large-scale solar power plants that have been criticized by conservationists.

"Without more careful calibration of these policies, Californians may wind up paying more than necessary for electricity and the state may unnecessarily degrade pristine habitat in its rush to implement renewable energy goals," Hancock said in a statement.

The high price for renewable contracts has been noted by the Division of Ratepayer Advocates, a utility watchdog agency. But the California Public Utilities Commission said newer agreements ? which remain confidential for three years ? reflect lower costs.

The utilities commission said Monday that it has been working on a forecasting analysis that shows overall rates will increase by 2% to 3% over the next five years ? a rise that the agency said was mostly accounted for by infrastructure improvements unrelated to renewable energy.

Many of the report's conclusions were echoed in another recent analysis that looked critically at the state's regulatory maze and how increased renewable energy might complicate California's electrical supply and delivery system.

"Stress in the institutional structure of California's electricity system can already be observed," said a report issued last week by Stanford's Hoover Institution, which is not related to the Little Hoover Commission. "California has 11 programs for renewable power development, with differing goals, timelines and criteria. Electric utilities are forecasting increased costs and rates after decades of relative stability."

In 2011, 62.3 percent of people had a credit score between 749 and 300, according to the?MyFICO blog, managed by the Fair Isaac Corporation. Most people in that range fell between 650-699 (12.1 percent) and 700-749 (15.5 percent).

Those are decent credit scores. Within that range, you would get approved for most credit products with acceptable interest rates. I should know. I bounced around between 650 and 749 for most of my adult life ? until I decided to boost my OK credit score into greatness two years ago. Today, I fall into the 800-850 range, shared by 18.3 percent of the U.S. consumer population last year. With that credit score, I get the best offers and the best rates on almost everything.

It wasn?t easy, but I learned a few tricks to boost a credit score quickly along the way. Here are my favorites.

1. Dispute errors?even the small ones

Your first step: Order a copy of all three credit reports from the major players ? Equifax, TransUnion, and Experian. You can order one free copy per year from each credit bureau through?AnnualCreditReport.com. Order your reports, print a copy, and start reviewing.

Look for the big errors first, things like accounts that don?t belong to you, paid balances that are showing as unpaid, and credit limits that are reported incorrectly. Highlight each one of these errors and then dispute them with the credit bureau. You can file a dispute online through each of the credit bureaus? websites:

After I disputed the big stuff, my financial adviser told me not to sweat the small things like credit inquires or incorrect dates. I didn?t listen. Instead, I disputed everything, thinking every point mattered. If a creditor pulled my credit without my permission, I disputed it. If my?credit card?company reported my balance higher than it should have been six months ago, I disputed it. In total, I raised my credit score 88 points by disputing every little error.

By law, the credit bureaus must investigate valid claims and remove inaccurate information, but if you run into trouble, complain to the?Consumer Financial Protection Bureau.

2. Add missing accounts

Once I cleaned up my credit history, I started looking for ways to build it. I did this by looking for credit lines that could have been included in my file, but weren?t. For example, I?ve had a cell phone in my name for 10 years, but those payments didn?t appear on my credit report. So I made a list of every company I paid monthly, contacted the companies, and asked them to report my payment history to the credit bureaus. Below are the types of companies that were willing to report on my behalf:

  • Wireless provider
  • Cable and Internet provider
  • Utility company
  • Telephone company

Keep in mind, however, that no company is required to report your payments, on-time or not, and many utility companies won?t. So when you approach companies like those above, you?re asking for a favor, not making a demand. 3. Pay down your highest balance

If you?re carrying balances on several credit cards, it?s tempting to pay off your smaller balances first, thinking that will motivate you to attack the larger debts. But if you?re trying to boost your credit score quickly, you should start by paying off the credit card with the lowest available credit limit. For example, say you have two credit cards. One credit card has a $1,600 limit with a $400 balance, which means 25 percent of your available credit is being used. The second card has a $1,000 limit with an $800 balance, meaning 80 percent of your available credit is being utilized. In this case, the second credit card is doing worse damage to your credit score because of its higher utilization ratio. Pay it off first and your credit score will improve faster.

4. Pay by your report date, not your due date

Obviously, if you want good credit, you?ll pay your bills on or before their due date. But if you want to maintain a high credit score, it may be a good idea to pay some earlier ? before balances are reported.

For example, say your credit card company reports your balance to credit reporting agencies every month on the 10th, but your bill is due on the 20th. At the first of the month you charge $5,000, but pay your bill in full on the 20th. As far as you?re concerned, you?re not carrying a balance: you got your bill and paid it by the due date. But if someone checks your credit on the 15th, the credit reporting agency will report you have a $5,000 balance.

I called my creditor and asked what day they reported my payment history, which turned out to be a week earlier than my due date. From that moment on, I?ve made my credit card payment before the reporting date, not the due date. That means if my credit is pulled, I always show a zero balance on my plastic.

5. Blend your credit

Three years ago I applied for an auto loan and was denied because I didn?t have a good mix of credit types. Lenders like to see that you can manage different types of credit and handle multiple accounts at once, but I only had two major credit cards. So I applied for a small installment loan (one with fixed payments and an established due date) from my bank and paid it back over 12 months. Adding installment credit to my already established revolving (credit card) credit lines boosted my credit score by about 30 points.

6. Keep using your credit cards

Several years ago I heard a nugget of financial wisdom, ?When you?re rebuilding your credit, tear up your credit cards.? Now, if you?re struggling to manage your spending habits, this is sound advice, but if you?re just trying to raise your credit score, cutting up your?credit cards?can be more harmful than helpful. For example, I spent nearly a year trying to improve my credit score. During that time, I put a small amount on both of my credit cards each month and then made sure I paid the balance on time. While I was disputing errors and working on building up new credit, I was also adding 12 months of on-time payments to my existing credit score.

The bottom line ? every month counts. If you can manage your credit cards, keep using them.

7. Ask for a credit line increase

Your credit utilization ratio, mentioned briefly above, is something lenders use to see how you?re managing your available credit. For example, if you have a $15,000 available credit limit and a $400 balance, you?re utilizing little of your available credit, so you look strong. If you carry that same $400 balance on a card with a $500 credit limit, you?ve borrowed nearly as much as you can, making you appear more risky.

While paying off your balance is the best solution, I found a quick fix that improved my credit score while I was paying off debt. I simply called my credit card company and asked if they would increase my available credit limit. They agreed and raised my limit, which lowered my overall credit utilization ratio and gave me a 15 point boost.

8. Protect your credit (once you have it)

Once your credit score is in the prime range, do everything you can to protect it. When you have several late payments, collection accounts, and charge-offs, one mistake won?t hurt you too much, but when you have a near-perfect credit score, even one late payment will cause a big drop. Make sure you pay your bills on time, don?t max out your credit cards, and never co-sign for someone else?s debt. If the co-signer doesn?t pay the bill, your credit could end up worse than ever before.?

The U.S. Bankruptcy Code provides federal courts with the authority to oversee all bankruptcy cases. To facilitate the process and provide bankruptcy petitioners and creditors with clear guidelines for filing, the Federal Rules of Bankruptcy dictate all the legal rules and contain all official forms. Cases are filed in district courts and overseen by a United States bankruptcy judge. This official evaluates the claims, determines if bankruptcy is permissible under law and assigns trustees who ensure that all terms of bankruptcy are adhered to. Chapter 11 is a form of bankruptcy used by businesses and sole proprietors seeking to continue operations and repay outstanding debts concurrently.

What Can Filing for Chapter 11 Do for You?

Chapter 11 bankruptcy allows you to repay creditors and maintain control of your finances by filing a plan of reorganization. After a bankruptcy case is filed, you have 120 days to develop a plan for reorganization that tells the court and creditors how you will repay debts. The judge will evaluate the plan and approve or reject it based on its merits and the opinions of your creditors. This is ideal for businesses and sole proprietorships in debt because, if approved, the debtors may reduce debts and even terminate contracts and leases in an effort to keep assets and make a profit. Most businesses filing under Chapter 11 are able to consolidate and operate with financial obligations that are more manageable.

Individual Requirements for Chapter 11

To file a successful Chapter 11 claim, you must follow certain rules established by the United States Bankruptcy Code. If you are an individual, you are prohibited from filing for bankruptcy for 180 days if you submitted a prior filing that a judge dismissed because of your failure to appear before the court or follow court orders. You are also prevented from filing if a previous Chapter 11 claim was voluntarily discharged due to creditors receiving relief through the liquidation of property they held liens on. Since Chapter 11 is mostly meant for companies, individuals seeking relief under this claim must also attend credit counseling from an approved agency within 180 days before filing. Credit counseling may be beneficial because you may use the advice of an expert to develop a debt management plan that can be offered to the court as a means of reorganization.

Filing and Discharge

There are two ways to initiate a petition for Chapter 11 bankruptcy: voluntarily and involuntarily. Voluntary petitions are filed by the debtor, while involuntary petitions are brought by creditors. If you are filing a voluntary petition, you must include an account of your assets and liabilities, all current income and expenses, a list of all contracts and a statement explaining your current financial situation. Married couples have the option to file jointly or separately. Once a petition is entered and the plan for reorganization is reviewed, the judge enters an order for relief and the debtor becomes known as the ?debtor in possession.?

The title of ?debtor in possession? refers to the influence you have over your financial future. Unlike other bankruptcy filings where a trustee is appointed and controls all assets, individuals filing under Chapter 11 keep and control of their assets, continue to manage their businesses and perform the duties that a trustee would perform. When compiling a plan for reorganization, make sure that you include enough information for judges and creditors to make informed decisions about the quality of the plan. Once the plan is accepted, you will be discharged from any debt you built before acceptance and will pay your debtors according to the provisions provided in the reorganization plan.

La. town evacuates; police relocate explosives

NEW ORLEANS (AP) ? A town in northwest Louisiana was being evacuated and state police were starting a criminal investigation of a company after finding about 6 million pounds of explosive material used in howitzers they say was stored illegally.

Boxes and small barrels of the M6 artillery propellant were found both outdoors and crammed into unauthorized buildings leased by Explo Systems Inc. at Camp Minden, the former Louisiana Army Ammunitions Plant, state police superintendent Col. Mike Edmonson said Sunday.

Police were evacuating the town of Doyline, about 270 miles northwest of New Orleans. About half the town's 800 residents left Friday.

The company's "careless and reckless disregard made it unsafe for their own employees, for schoolchildren in Doyline, for the town of Doyline," Edmonson said.

The company is located on a portion of the former ammunition plant's 15,000 acres that is leased for commercial use. Other sections are used for National Guard training.

Capt. Doug Cain, a state police spokesman, identified the product as M6 propellant, used in howitzers and other artillery. The pellets are largely compressed nitrocellulose, also known as guncotton.

Authorities had initially estimated the total at 1 million pounds after an investigator looking into an Oct. 15 explosion at Explo Systems saw cardboard boxes on long rows of pallets behind a building. They found more stacked in sheds and warehouses when crews returned Saturday to begin moving the boxes into bunkers about two miles away on the former munitions site, which covers nearly 23.5 square miles just north of Doyline.

"It wasn't in their storage magazines. They had it hidden on the property, away from the storage magazines where we would expect to find it," Cain said.

Edmonson said, "It was stuffed in corners. It was stacked all over."

He said that in two days, crews have moved just under a million pounds from the tightest-packed buildings into approved containers and onto 27 tractor-trailers to move to storage bunkers. Another 250,000 pounds has been moved a safe distance from the bulk of the material.

It won't all have to be moved into bunkers to let people return home ? the evacuation could be lifted once the propellant is divided into amounts that won't threaten the town if some ignites, with each area a safe distance from the others, Edmonson said.

Company officials could not be reached Sunday. The owners reportedly are returning Monday from a business trip to South Korea, but the manager has been working with state police from the start, Edmonson said.

Doyline was used to film some scenes for the HBO vampire series "True Blood."

(AP) ? Detectives have long wondered what secrets serial killer John Wayne Gacy and other condemned murderers took to the grave when they were executed ? mostly whether they had other unknown victims.

Now, in a game of scientific catch-up, the Cook County Sheriff's Department is trying to be creative: They've created DNA profiles of Gacy and others and figured out they could get the executed men entered in a national database shared with other law enforcement agencies because the murderers were technically listed as homicide victims themselves when they were put to death by the state.

The department's hope is to find matches of DNA evidence from blood, semen or strands of hair, or skin under the fingernails of victims that link the long-dead killers to the coldest of cold cases. And they're hoping to prompt authorities in other states to submit the DNA of their own executed inmates or from decades-old crime scenes.

"You just know some of these guys did other murders" that were never solved, said Jason Moran, the sheriffs' detective leading the effort, noting that some of the executed killers ranged all over the country before the convictions that put them behind bars for the last time.

The Illinois testing, which began during the summer, is the latest chapter in a story that began when Sheriff Tom Dart exhumed the remains of unknown victims of Gacy to create DNA profiles that could be compared with the DNA of people whose loved ones went missing in the 1970s, when Gacy was killing young men.

That effort, which led to the identification of one Gacy victim, caused Dart to wonder if the technology could help answer a question that has been out there for decades: Did Gacy kill anyone besides those young men whose bodies were stashed under his house or tossed in a river?

"He traveled a lot," Moran said of Gacy. "Even though we don't have any information he committed crimes elsewhere, the sheriff asked if you could put it past such an evil person."

After unexpectedly finding three vials of Gacy's blood stored with other Gacy evidence, Moran learned the state would only accept the blood in the crime database if it came from a coroner or medical examiner.

Moran thought he was out of luck. But then Will County Coroner Patrick O'Neil surprised him with this revelation: In his office freezer were blood samples from Gacy and at least three other executed inmates. The reason they were there is because after the death penalty was reinstated in Illinois in the 1970s, executions were carried out in Will County ? all between 1990 and 1999, a year before then-Gov. George Ryan established a moratorium on the death penalty. So it was O'Neil's office that conducted the autopsies and collected the blood samples.

But there was bigger obstacle.

While the state does send to the FBI's Combined DNA Index System the profiles of homicide victims no matter when they were killed, it will only send the profiles of known felons if they were convicted since a new state law was enacted about a decade ago that allowed them to be included, Moran said.

That meant the profile of Gacy, who received a lethal injection in 1994, and the profiles of other executed inmates could not qualify for the database under the felon provision. They could, however, qualify as people who died by homicide.

"They're homicides because the state intended to take the inmate's life," O'Neil said.

Last year, authorities in Florida created a DNA profile from the blood of executed serial killer Ted Bundy in an attempt to link him to other murders. But officials there, where the law allows profiles of convicted felons be uploaded into the database as well as the phase-in of profiles of people arrested on felony charges, don't know of any law enforcement agency reaching back into history the way Cook County's sheriff's office is.

"We haven't had any initiative where we are going back to executed offenders and asking for their samples," said David Coffman, director of Florida Department of Law Enforcement's laboratory system. "I think it's an innovative approach."

O'Neil said he is still looking for blood samples of the rest of the 12 condemned inmates executed between 1977 when Illinois reinstated the death penalty and 2000 when then-Gov. George Ryan established a moratorium. So far, DNA profiles have been done on the blood of Gacy and two others; the profile of the fourth inmate has not yet been done.

Among the other executed inmates whose blood was submitted for testing was Lloyd Wayne Hampton, a drifter executed in 1998 for his crimes. Not only did Hampton's long list of crimes include crimes outside the state ? one conviction was for the torture of a woman in California ? but shortly before he was put to death, he claimed to have committed other murders but never provided details.

So far, no computer hits have linked Gacy or the others to any other crimes. But Moran and O'Neil suspect there are investigators who are holding DNA evidence that could help solve them.

That is exactly what happened during the investigation into the 1993 slayings of seven people at a suburban Chicago restaurant, during which an evidence technician collected a half-eaten chicken dinner even though there was no way to test it for DNA at the time.

When the technology did become available, the dinner was tested and it revealed the identity of one of two men ultimately convicted in the slayings.

Moran says he wants investigators in other states to know that Gacy's blood is now open for analysis in their unsolved murders. He hopes those jurisdictions will, in turn, submit DNA profiles of their own executed inmates.

"That is part of the DNA system that's not being tapped into," he said.

Fed trio spars on low-rate policy ahead of December meeting

CHICAGO (Reuters) - Three top Federal Reserve officials on Saturday offered sharply different takes on the U.S. central bank's unprecedented efforts to push down long-term borrowing costs, highlighting what may be some key themes at the Fed's upcoming policy-setting meeting.

Charles Evans, the dovish president of the Chicago Fed, made no bones about his view that more policy accommodation is needed, repeating his call for keeping rates low until unemployment falls to at least 6.5 percent, as long as inflation does not threaten to rise above 2.5 percent.

"We are in a period where having low policy rates for a very long time would be helpful," he said at panel at the University of Chicago sponsored by the university's Becker Friedman Institute for Research

Also on the panel, which was held ahead of the Fed's December 11-12 closed-door policy meeting, were Charles Plosser, the hawkish president of the Philadelphia Fed, and Minneapolis Fed President Narayana Kocherlakota -- a former advocate of policy tightening who in September began calling for further easing.

Showing a series of slides to a mostly student audience, Evans argued that high joblessness now means that even with interest rates kept low for years, inflation is unlikely to rise above 2.3 percent.

But Plosser, seated between Evans and Kocherlakota on the panel, said he is worried that the continuing high unemployment rate may mean the Fed's policies are not working as expected.

With unemployment at historically high levels - it ticked up to 7.9 percent in October -- and inflation low, policymakers could "walk away from that evidence and say, either we haven't done enough, or we haven't got the right model of how the transmission mechanism is working," Plosser said.

He also expressed concern about reversing the Fed's longstanding low-rate policy. Although the Fed has the tools to raise rates, he said, "History suggests that it's always been easier for the Fed to lower rates than to raise them."

The Fed has kept short-term rates almost at zero percent since December 2008 and has bought some $2.5 trillion in bonds to drive down longer-term borrowing costs and boost the recovery from recession.

It has also said it expects to keep rates low until at least mid-2015, as it works to bring down too-high unemployment.

Since September the Fed has been buying a total of $85 billion in long-term securities each month to help push down borrowing costs. Part of that is the program known as Operation Twist, in which the Fed buys $45 billion in longer-term Treasuries and sells the same amount of shorter-term ones.

Twist expires at year end, and officials will need to decide at their December meeting whether to ramp up the quantitative easing program, dubbed QE3, to make up for the shortfall.

Under QE3, the Fed has said it would buy $40 billion in mortgage-backed securities per month until the outlook for the labor market improves substantially.

THE MERITS OF THRESHOLDS

The three policymakers on Saturday gave no hint as to their views on what the Fed should do, although Evans has previously advocated for keeping asset purchases at a monthly rate of $85 billion, while Plosser has said he does not view Twist's expiration necessarily as tightening.

Instead, the three debated the merits of adopting thresholds for inflation and unemployment as guideposts for policy. Fed officials have been discussing such plans for months, although few economists believe they will come to a decision in December.

"I'm terribly worried that we are asking too much of policy here," Plosser said, of the value of setting thresholds. "I'm worried that the strategies are going to sow more confusion than clarity."

Kocherlakota, like Evans, reiterated his support for a threshold-based policy. The Minneapolis Fed chief -- who, like Plosser, did his graduate training in economics at the University of Chicago -- repeated his call for the Fed to keep rates low until the jobless rate reaches 5.5 percent or even below, as long as inflation does not threaten to rise above 2.25 percent.

Such a promise is "credible," he said, because it shows investors the Fed will not sacrifice price stability in order to reduce unemployment. The Fed in January set an inflation target for the first time, aiming at 2 percent inflation.

"I think we are falling short on both metrics, more so on employment than inflation," he said, referring to the Fed's mandates to keep prices stable and to maximize employment.

Evans also emphasized his "inflation safeguard" of 2.5 percent, saying that if he is wrong and easier monetary policy is not the answer to unemployment, inflation will rise, and the Fed can then take its foot off the gas pedal.

Plosser said he was "dubious." The public could easily misinterpret an inflation "threshold" as a target that conflicts with the Fed's newly adopted 2 percent inflation goal, he said.

"I am worried that the commitment we have is not credible, or is not well understood, and we won't get the effects that these models tell us," Plosser said.

Inflammation may be a cause of plaque buildup in heart vessels

ScienceDaily (Dec. 2, 2012) ? Fifteen new genetic regions associated with coronary artery disease have been identified by a large, international consortium of scientists -- including researchers at the Stanford University School of Medicine -- taking a significant step forward in understanding the root causes of this deadly disease. The new research brings the total number of validated genetic links with heart disease discovered through genome-wide association studies to 46.

Coronary artery disease is the process by which plaque builds up in the wall of heart vessels, eventually leading to chest pain and potentially lethal heart attacks. It is the leading cause of death worldwide.

The study, published online Dec. 2 in Nature Genetics, provides insights into the molecular pathways causing coronary artery disease, which is also known as coronary atherosclerosis.

"Perhaps the most interesting results of this study show that some people may be born with a predisposition to the development of coronary atherosclerosis because they have inherited mutations in some key genes related to inflammation," said Themistocles (Tim) Assimes, MD, PhD, a Stanford assistant professor of medicine and one of the study's lead authors. "There has been much debate as to whether inflammation seen in plaque buildup in heart vessels is a cause or a consequence of the plaques themselves. Our network analysis of the top approximately 240 genetic signals in this study seems to provide evidence that genetic defects in some pathways related to inflammation are a cause."

More than 170 researchers were involved in this massive meta-analysis combining genetic data from more than 190,000 research participants. Interestingly, about a quarter of the genetic regions associated with coronary disease or heart attack were also found to be strongly associated with cholesterol, especially high levels of the so-called bad cholesterol known as LDL. Another 10 percent were associated with high blood pressure. Both of these conditions are known risk factors for coronary artery disease.

"The signals that do not point to known risk factors may be pointing to novel mechanisms of disease," Assimes said. "It is imperative that we quickly gain a better understanding of how these regions are linked to heart disease, as such understanding will greatly facilitate the development of new drugs to prevent heart disease."

Genome-wide association studies, or GWAS, were first introduced in 2005 as a way of quickly scanning the entire genome to identify differences in the DNA code, or "polymporphisms," that predispose people to various common but genetically complex diseases. Results of these studies have shown that conditions such as heart disease involve the combined, subtle effects of far more polymorphisms than initially expected, requiring multiple massive meta-analyses such as this one to reliably uncover all of these genetic signals. The hope of scientists is that by working together in ongoing worldwide collaborations, the entire genetic contribution to the cause of heart disease will eventually be identified.

"Studies like this one help provide new pathways for scientists to investigate in more detail," said co-author Thomas Quertermous, MD, a Stanford professor of medicine. "The promise is in providing better insights into the pathophysiology of this disease."

This meta-analysis study built upon previous research published last year in Nature Genetics. In that study, investigators examined 2.5 million SNPs (genetic variants at specific locations on individual chromosomes) from 14 GWA studies, which led to the discovery of 13 new gene regions associated with heart disease. Investigators looked at data from the complete genetic profiles of more than 22,000 people of European descent with heart disease and more than 64,000 healthy people.

In the new study, scientists used all information from last year's study then added to it, reaching 41,513 patients with heart disease and 65,919 control patients. To genetically fingerprint a large number of subjects in a very cost-effective manner, the researchers used a specialized genetic chip that incorporated only the top signals from the original meta-analysis of the initial 14 GWA studies.

Syria Crisis: Opposition Coalition Edges Toward Appointing Transition Prime Minister


CAIRO, Nov 30 (Reuters) - Syria's new opposition coalition edged closer on Friday toward choosing a prime minister to lead a transitional government after three days of talks in Cairo that furthered the dominance of the Muslim Brotherhood.
Former Prime Minister Riad Hijab, a longtime apparatchik in President Bashar al-Assad's Baath Party before he defected in August, is the strongest candidate for the job, delegates said.
Hijab, who is backed by Jordan and Gulf states, is likely to be chosen before or during a gathering in mid-December of the Friends of Syria, according to coalition insiders.
The grouping of dozens of nations had pledged mostly non-military backing for the revolt but is worried by the influence of Islamists in the opposition.
A popular uprising erupted in March 2011 against Assad's autocratic rule in which 40,000 people have been killed and hundreds of thousands forced to flee the country
Coalition member Louay Safi said the prime minister would be the point man for the coalition with the international community and act as the head of an alternate Cabinet ready to fill the political and security void if Assad falls from power.
Members of the new government cannot be members of the coalition, which numbers 60.
"I think Hijab has the best chance. He has taken big risks to defect and has since come across as a balanced and composed choice," said coalition member Munther Bakhos, a veteran opposition figure forced to flee Syria during the 1970s, as bloody repression by Assad's father, late President Hafez al-Assad, intensified, eventually killing many thousands.
Under internal coalition rules reached late into the night, the prime minister will be elected by a simple majority in the coalition, in which the Brotherhood and its allies have more than 50 percent of the seats.
Candidates must have contributed to the 20-month revolt against Assad and not be tainted by corruption, according to internal rules reached at 2 a.m. (midnight GMT).

NEW EXECUTIVE BODY
The coalition earlier on Friday created an executive body, less than a month after the group came into being with Western and Arab support.
The 11-member "political assembly" will be headed by moderate preacher Moaz al-Khatib, the current president of the coalition.
They will include his two vice presidents and the coalition's secretary general, Qatari-backed businessman Mustafa Sabbagh, who has emerged as one of the most powerful figures in the new structure.
But the delegates failed to agree on the names of the 11 members after a lengthy election procedure and postponed deciding on the issue, delegates said.
Hardball politics have overshadowed the three-day proceedings in Cairo, with the Brotherhood becoming an overwhelmingly powerful kingmaker.
Since the coalition was set up in Qatar earlier this month, the Brotherhood has swiftly assembled a de facto majority bloc, according to insiders keeping track of changes in the membership of the coalition.
The revolt against four decades of rule by Assad and his late father revived the Brotherhood's fortunes after decades of repression that killed many thousands of its members, and opened more sources of financing for the organisation from exiled conservative Syrians.
France, Britain, Turkey and Gulf Arab states have already recognised the coalition as the legitimate representative of the Syrian people. The United States has been more cautious.
Hijab is a Sunni Muslim from the desert oil-producing province of Deir al-Zor in the east of Syria, on the border with Iraq's Sunni heartland.
Alliances in Deir al-Zor between Sunni Muslim tribes and the ruling elite from Assad's minority Alawite sect, an offshoot of Shi'ite Islam that has dominated power in Syria since the 1960s, collapsed after Assad's forces shot scores of demonstrators in the province at the beginning of the revolt.

(AP) ? Giant crowds of protesters packed Cairo's Tahrir Square and marched in other cities Friday vowing to stop a draft constitution that Islamist allies of President Mohammed Morsi approved hours earlier in a rushed, all-night session without the participation of liberals and Christians.

Anger at Morsi even spilled over into a mosque where the Islamist president joined weekly Friday prayers. In his sermon, the mosque's preacher compared Morsi to Islam's Prophet Muhammad, saying the prophet had enjoyed vast powers as leader, giving a precedent for the same to happen now.

"No to tyranny!" congregants chanted, interrupting the cleric. Morsi took to the podium and told the worshippers that he too objected to the language of the sheik and that one-man rule contradicts Islam.

Crowds of protesters marched from several locations in Cairo, converging in central Tahrir Square for the opposition's second mass rally in a week against Morsi. They chanted, "Constitution: Void!" and "The people want to bring down the regime" as fireworks went off.

The crowd appeared comparable in size to the more than 200,000 anti-Morsi protesters who thronged Tahrir on Tuesday. Tens of thousands more marched Friday in Alexandria and other cities.

In contrast to the largely leaderless uprising by youth activists against autocrat Hosni Mubarak last year, a more energized, cohesive leadership has started to emerge in the new campaign against Morsi, Egypt's first freely elected president. It is made up of a number of prominent liberal, secular and moderate Islamist politicians, notably reform advocate Mohamed ElBaradei.

"We are determined to continue with all peaceful means, whatever it takes to defend our legitimate rights," ElBaradei told the Tahrir crowd, saying the draft constitution must be voided.

His ally, senior opposition leader Hamdeen Sabbahi, vowed protests would go on until "we topple the constitution."

"The revolution is back ... We shall be victorious," said Sabbahi, a liberal politician who came in a surprisingly close third in last summer's presidential election. "We are united against the oppressive regime."

The protests were sparked by the president's decrees a week ago granting himself sweeping powers and neutralizing the judiciary, the last check on his authority. The edicts tapped into a feeling among many Egyptians that Morsi and the Muslim Brotherhood, from which he hails, are using their election victories to monopolize power and set up a new one-party state, nearly two years after the fall of autocrat Hosni Mubarak.

But the sudden adoption of a draft constitution by the Islamist-dominated assembly tasked with producing the document throws the confrontation into a new phase.

The draft must now be put to a nationwide referendum for public approval, likely to be held in mid-December. Morsi is expected on Saturday to announce the date. He says his new powers are in effect until the referendum passes.

The opposition appeared determined to launch a street campaign aimed at blocking the document from coming to a referendum.

They are also counting on a revolt by the judiciary, where opposition to Morsi's edicts runs strong. The Supreme Constitutional Court is to rule on Sunday whether to dissolve the constitutional assembly. If it does so, the effect on the draft already adopted by the assembly is unclear. In part it may be a question of whose legitimacy is stronger and whose public support is larger.

If the charter does come to a referendum, the opposition is faced with the choice of boycotting in protest or trying to rally the public to vote to reject the draft.

In every scenario, Egypt's most polarizing and volatile crisis since Mubarak's ouster is likely to deepen. The past week, clashes between Morsi's supporters and opponents left two dead and hundreds wounded and raised fears of further chaos.

The Brotherhood and other Islamists plan their own massive rally backing Morsi on Saturday. Already on Friday, Brotherhood activists were passing out fliers calling for the public to come out and "support Islamic law." A number of Muslim clerics in Friday sermons in the southern city of Assiut called the president's opponents "thugs" and "enemies of God and Islam."

The draft constitution has an Islamist bent. It strengthens provisions that set Islamic law as the basis of legislation, gives clerics a still undefined role in ensuring laws meet Shariah and commits the state to enforce morals and "the traditional family" in broad language that rights activists fear could be used to severely limit many civil liberties.

At the same time, it installs new protections for Egyptians against some abuses of the Mubarak era, such as stronger bans on torture and arbitrary arrest. It weakens somewhat what had been the near total powers of the presidency, giving parliament greater authorities.

Almost all liberal and secular members of the assembly had quit in the past weeks to protest what they called Islamists' hijacking of the drafting process.

As a result, 85 members ? almost all Islamists, with no Christians ? participated in the session that began Thursday. The voting, which had not been expected for another two months, was hastily moved up to approve the draft before the Constitutional Court rules Sunday.

Racing against the clock, the members voted article by article for 16 hours on the draft's more than 230 articles, passing them all by large margins.

The rush resulted in a process that at times appeared slap-dash. Assembly head Hossam al-Ghiryani doggedly pushed the members to finish.

When one article received 16 objections, he pointed out that would require postponing the vote 48 hours under the body's rules. "Now I'm taking the vote again," he said, and all but four members dropped their objections.

In the session's final hours, several new articles were hastily written up and swiftly voted on to resolve lingering issues. One significant change would reduce the size of the Supreme Constitutional Court by nearly a third to 11 judges, removing several younger, sharply anti-Brotherhood judges.

The voting ended just after sunrise Friday, to a round of applause from the members.

"This constitution represents the diversity of the Egyptian people. All Egyptians, male and female, will find themselves in this constitution," declared Essam el-Erian, a representative of the Muslim Brotherhood.

But the opposition denounced the vote as a farce.

Among the protesters in Tahrir on Friday, Salwa Mustafa said the constitution was "cooked up."

Her daughter, Basma Mohieddin, who was marching with her, added, "We must not let this charter reach the referendum because you know that people are easily fooled. We have to stop it right now and cancel it."

Speaking in an interview on state TV aired late Thursday, Morsi said the constitution's swift passage was necessary to get Egypt through a transitional period in which there has been no elected lower house of parliament. The courts dissolved the Brotherhood-led lower house elected last winter.

"The most important thing of this period is that we finish the constitution, so that we have a parliament under the constitution, elected properly, an independent judiciary, and a president who executes the law," Morsi said.

Rights group Amnesty International said Friday that the adopted text of the constitution has provisions that purport to protect rights but instead "mask new restrictions."

As in past constitutions, the new draft said the "principles of Islamic law" will be the basis of law.

Previously, the term "principles" allowed wide leeway in interpreting Shariah. But in the draft, a separate new article is added that seeks to define "principles" by pointing to particular theological doctrines and their rules. That could give Islamists the tool for insisting on stricter implementation of rulings of Shariah.

Another new article states that Egypt's most respected Islamic institution, Al-Azhar, must be consulted on any matters related to Shariah, a measure critics fear will lead to oversight of legislation by clerics.

The draft also includes bans on "insulting or defaming all prophets and messengers" or even "insulting humans" ? broad language that analysts warned could be used to crack down on many forms of speech.

The draft says citizens are equal under the law but an article specifically establishing women's equality was dropped because of disputes over the phrasing.

One article underlines that the state will protect "the true nature of the Egyptian family ... and promote its morals and values." The phrasing suggests the state could prevent anything deemed to undermine the family.

Hassiba Hadj Sahraoui, Amnesty's deputy director for the region, said the document "blocks the path to equality between men and women. It is appalling that virtually the only references to women relate to the home and family."
